Collection and storage of personal data and the nature and purpose of its use


When visiting the website

When you visit our website www.die.ag, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the accessed file,
  • the website from which access was made (referrer URL)
  • browser used and, if applicable, the operating system of your computer and the name of your access provider.

The aforementioned data is processed by us for the following purposes:

  • Ensuring a smooth connection to the website,
  • Ensuring a comfortable use of our website,
  • evaluating system security and stability and
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your person.

If you have expressly consented in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR by entering your data in our form at https://www.die.ag/presse, we will use your e-mail address to regularly send you our press releases and invite you to press events.

b) When registering for our purchase profile

If you have expressly consented in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR by entering your data in our form at https://www.die.ag/ankauf, we will use your e-mail address to send you our purchase profile on a regular basis.

c) When registering for our newsletter

If you have expressly consented in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR by entering your data in our form at https://www.die.ag/presse, we will use your e-mail address to send you our newsletter on a regular basis.

With the following information, we inform you about the registration, dispatch and evaluation procedure and clarify your rights of objection. If you subscribe to our notifications with advertising information (hereinafter “newsletter, press releases and purchase profiles”), you agree to receive the newsletter and the procedures described.

Content: We only send electronic notifications with advertising information on the basis of the recipient’s consent or on the basis of legal permission. If we specifically describe individual promotional information as part of the registration process, this description is decisive for consent. If no separate description is provided, you will receive our advertising information about our products, offers and promotions as well as information about our company.

Double opt-in: Registration for our advertising information (hereinafter “newsletter, press releases and purchase profiles”) takes place using the double opt-in procedure. This means that after registration we will send you an e-mail in which we ask you to confirm your registration. This confirmation serves to ensure that only persons who have access to the e-mail address provided can register with us. The logging of the registration process is based on our legitimate interest in accordance with Art. 6 para. 1 sentence 1 lit. f) GDPR and serves as proof of consent to the receipt of advertising information.

You can unsubscribe from receiving our advertising information at any time, i.e. revoke your consent. You will find a link to unsubscribe at the end of every promotional email you receive from us. If users have registered for advertising information and have canceled this registration, their personal data will be deleted.

Forwarding of data

Within the company, those departments that require your data to fulfill our contractual and legal obligations will have access to it. Data will only be passed on to third parties within the framework of legal requirements. We only pass on user data to third parties if this is necessary, for example, on the basis of Art. 6 para. 1 lit. b) GDPR for contractual purposes or if you have consented to the transfer of data or on the basis of legitimate interests pursuant to Art. 6 para. 1 lit. f. GDPR in the economic and effective operation of our business. To process your contact request, data may therefore be passed on to our affiliated companies if this is necessary to answer your request. When using the website for purely informational purposes, we do not pass on any data to third parties. Processors employed by us (Art. 28 GDPR) may also receive data for the above-mentioned purposes. These are companies in the categories of IT services, logistics, printing services, telecommunications, advice and consulting as well as sales and marketing. Is data transferred to a third country or to an international organization?

The data provided will be processed within the European Union and in the USA. For countries without an adequacy decision by the Commission in accordance with Article 45 GDPR, as is the case with the USA, we generally agree EU standard data protection clauses with the recipients of your data or obtain your consent for the data transfer.

Note: The protection of personal data in the USA does not correspond to the level of data protection required by the EU. In particular, there are no enforceable rights to protect your data against access by government agencies. There is therefore a risk that these government agencies may be able to access the personal data without the data transferor or recipient being able to effectively prevent this.

Storage period

For security reasons (e.g. to investigate misuse or fraud), log file information is stored for a maximum of 21 days and then deleted. Data whose further storage is required for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified. Where necessary, we process and store your personal data for the duration of our business relationship, which also includes, for example, the initiation and execution of a contract via the contact form or by email.

Applicant data will be deleted after 6 months in the event of rejection. In the event that you have consented to further storage of your personal data, we will transfer your data to our applicant pool. The data will be deleted there if you revoke your consent or after five years at the latest. If we fill the advertised position with you, your data will be stored in our personnel file.

Cookies

Cookies are pieces of information that are transferred from our web server or third-party web servers to the user’s web browser and stored there for later retrieval. We use Google Analytics, a web analysis service of Google Inc (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”) for the purpose of designing and continuously optimizing our pages to meet your needs. In this context, pseudonymized user profiles are created and cookies (see section 4) are used. The information generated by the cookie about your use of this website, such as

  • Referrer URL (the previously visited page),

are transmitted to a Google server in the USA and stored there. Our social media presence

You can find us on social networks and platforms so that we can also communicate with you there and inform you about our services.

We would like to point out that your data may be processed outside the European Union and that the data is generally processed for market research and advertising purposes. Usage profiles can be created from the usage behavior and resulting interests of the users. These usage profiles can in turn be used, for example, to place advertisements inside and outside the platforms that presumably correspond to the interests of the users. Rights of data subjects

You have the right:

  • Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 GDPR, to demand the immediate correction of incorrect or incomplete personal data stored by us;
